Please go through the following Terms and Conditions that govern the relationship between you (client) and Eve Holidays (P) Limited (hereinafter referred as “The Company”), Registered Company Number 179950 and Nepal Government Ministry of Tourism License No 2573. Please note that while booking a trip, you are agreeing to be bound by the Terms and Conditions as well as the cancellation policy and certain limitations of liability. Both parties agree to these Terms and Conditions to resolve any legal or other disputes that may arise during the trip.
A ‘trip’ refers to any product itinerary or activities that you buy with us including Trekking, Tours, Expeditions, and/or any other adventure and tour programs. Weather the booking deposit is sent through website booking page paying by credit card or by paying by bank transfer in our bank account or pay by cash, when you send the booking deposit it is deemed that you have read, understood and agreed to the trip cost, trip inclusions and our booking terms and conditions and you agree to abide by it.
Your booking is considered a confirmed booking only when the booking deposit sent by you is shown in our bank account and you receive the booking confirmation email from us. After receiving the final payment, this contract between the Company and the Client comes into existence.
We accept payments through following methods:
Bank charges while making payment by bank transfer and credit cards is your responsibility.
You can make a booking by choosing to deposit 20% of the trip cost at the time of booking the trip.
FOR NEPAL TRIPS: Final payment for trekking, tours, climbing, expedition or any kind of trips in Nepal can be made when you arrive here, before trip starts.
FOR TRIPS IN COUNTRIES OTHER THAN NEPAL: Final payment has to be made at least 30 days before trip departure.
Any cancellation by a Client must be made in writing and acknowledged by the Company. The date on which the request to cancel is received by the Company will determine the cancellation charge applicable.
- Concerning trip cancellations, the booking deposit serves as a lifetime deposit, transferable to any future Eve Holidays trips or another individual. However, if cancellation occurs within 30 days before the departure date, the booking deposit becomes nonadjustable and nonrefundable.
- Client pays full balance amount after arriving in Nepal. If any cancellation or leave the trip due to whatsoever reason after the trip starts, there will be no any refund of any amount. Please also note that no any refunds will be made for any accommodation, transportation, sightseeing, meals or any type of services not utilized.
Cancellation within 30 days of trip departure – your payment becomes non-refundable and non-adjustable
[The Client is strongly advised to take out cancellation insurance at the time of making the booking.]
Eve Holidays wont cancel any trip until and unless it is not possible to run. In such case Eve Holidays reserves the right to cancel any trip, including a guaranteed trip, prior to departure due to reasons beyond its control (i.e. due to natural disasters, flight cancellation, consequences of strikes, industrial action, wars, riots, sickness, quarantine, government intervention, weather condition etc.). If the Company has to cancel a departure, you are entitled to take an alternative trip of the same value. You will have to pay the difference amount, if the tour you take is of higher value. However, there will be no any refund, if you choose not to take another tour.
The Company must be notified in writing at the time of booking of any medical conditions, physically challenged conditions or any other mental and/or physical condition which may affect fitness to travel and or any medical condition. Failure to notify the Company may result in the client being refused travel. Failure to notify the Company of any such condition that results in cancellation will result in 100% cancellation fees to the Client.
Some trips may be unsuitable for Clients due to age, mobility, pregnancy or physical or mental conditions. It is the Client’s responsibility to check prior to booking. The Company is not required to provide any special facilities unless it has agreed to do so in writing. The Company will do its best to meet Clients special requests including dietary, but such requests do not form part of the Contract and therefore the Company is not liable for not providing these requests.
Medical facilities vary from country to country and the Company makes no representations and gives no warranties in relation to the standard of such treatment.
Please note that if you’ve chosen to join a group trek/trip, it’s essential to be able to keep up with the pace of other members and meet the itinerary requirements. If, for any reason, whether it be physical inability, social, emotional or any other reason, if you find yourself unable to continue with the group or unable to keep up with the itinerary and leave the group, there will be no refund of any amount paid. However, if you prefer to continue the trek/trip solo, we can make private arrangements for you, although please be aware that this requires last-minute arrangements and will cost you extra and may not be possible immediately.
Adequate and valid travel insurance is compulsory for all travelers. Your travel insurance must cover accidents, injury, illness and death medical expenses, including any related to pre-existing medical conditions, emergency repatriation (including helicopter rescue and air ambulance where applicable) and personal liability. The Company also recommends it covers trip cancellation, curtailment and loss of luggage and personal effects. You must carry proof of insurance with you and produce it if reasonably requested by the company employees. The company reserves the right to cancel or suspend your participation on a trip or in certain activities that comprise part of a trip, at any time, including after the commencement of your trip, with no right of refund, if you are unable to provide proof of insurance when requested.
Please note that mountain adventures are always unpredictable. Bad weather in mountain regions can cause flight delays and cancellations. This can happen even in the best season. In case of delayed domestic flights, the client is responsible to bear all additional expenses including food, accommodation, and salary of guide and porter and will be charged a per day cost according to the trip cost paid by the client [for example if the trip cost is 1000 US$ and the number of trip days is 10 days, it costs 100 US$ per day. So you will be required to pay additional 100 US$ per day for any additional waiting days in the mountains due to flight cancellations. ] However, if you prefer not to wait and wish to make an alternative arrangement such as Helicopter flight to avoid flight delays, we will help make arrangements but all additional cost of helicopter for you and your trekking guide would be your responsibility.
Moreover, Eve Holidays does not accept any responsibility for costs incurred as a result of missed international flight, but would assist to make alternative arrangements wherever possible. Please also note that while on the field, we may have to make some changes in the itinerary due to unforeseen circumstances.
You must carry a valid passport and have obtained the appropriate visas when traveling with Eve Holidays. Please ensure your passport is valid for 6 months beyond the duration of the trip. Nepal Visa is available on arrival in Nepal. For Tibet & Bhutan, the company can make necessary arrangements upon request.
It is your responsibility to ensure that you are in possession of the correct visas for the countries you are traveling to. Eve Holidays cannot accept responsibility if you are refused entry to a country or places because you lack the correct visa documentation.
There will be no discounts or money refunded for missed or unused services, this includes voluntary or involuntary termination/departure from tour, i.e. sickness, death of a family member etc., late arrival on the tour, or leave the tour due to not being able to keep up with the itinerary or premature departure either voluntarily or involuntarily.
Please read and understand what is included in your trip cost and what not. Company takes the responsibility of providing only what is included in the trip cost and only for the number of the days in the itinerary. Any other costs incurred due to any unforeseen circumstances while running the trip or any other costs not mentioned in the inclusion section means that they are not included.
We understand the seriousness of the emergency in the remote mountains. We try our best to send the helicopter at the earliest possible but at times, situations may arise when helicopter wont fly due to bad weather, or the limited number of helicopters are busy or it takes time (even days) to obtain permits from different authorities of Nepal Government to fly helicopter especially in the restricted areas of Nepal mainly near the border areas.
The Company reserves the right to update and amend these terms and conditions at anytime. It is the responsibility of the Client to keep updated with any changes. The current version of terms and conditions will always be found on the website www.eveholidays.com and will be the terms referred to in any dispute.
